Letting a young child ride up front can bring a fine for the driver since mid-August 2026. Children under 10 and shorter than 1.35 m may not sit in the driver's row, except in vehicles with only one row. Year-end trips often fill every seat, so plan the seating before you set off.

        Who is penalised

The driver is responsible, including on a self-drive rental. The fine for a child in the driver's row is VND 800,000–1,000,000. Holding a child on an adult's lap in the front still counts as a violation.

        Why the back is safer

Front airbags are designed for adults and deploy with great force, which can injure a small child. The back row is further from a head-on impact and is where a child seat is fitted properly.

        Seating a full car

        The exception

Vehicles with a single row, such as some light trucks or single-cab pickups, have nowhere else to put a child; the child must still use a suitable restraint. Ordinary family and tour vehicles are not covered by the exception.

        Seating plans by vehicle

The easiest way to stay within the rules is to decide who sits where before anyone gets in, especially with a big family and plenty of Tết luggage.

Vehicle Front row Row two Row three / rear
4–5 seat Adult Up to two child seats, an adult in the middle if it fits None
7 seat Adult Children in child seats or boosters Adults or older children over 1.35 m
9-seat limousine Adult Wide seats with room for a child seat and an adult alongside Adults, hand luggage
16 seat Adult Children in middle rows, an adult in each row

If there are more children than safe rear places, take a bigger vehicle or two cars rather than putting a child in the passenger seat.

        Real situations on the road

Picking up grandparents and the back is full

Grandparents take the front passenger seat; the children stay in the back. Never swap them round.

A crying child wants Mum's lap in front

Sitting on an adult's lap in the front is still a violation and very dangerous if the airbag fires. Pull over safely, settle the child and buckle up again; Mum can sit beside them in the back.

        Short village hops at Tết

A few hundred metres between relatives' houses is still a road trip. Keep the same seating as on a long drive; low-speed crashes still injure.

        Over 10 but under 1.35 m

The rule mentions both age and height; a child old enough but still short is safer in the back on a booster so the belt sits correctly.

        Airbags and children

Weekend family trips: seating for the whole day

Ho Chi Minh City – Vũng Tàu

The expressway makes it short, but the car is full and children want to swap seats. Settle it at the start: children in row two with an adult beside them, another adult in row three with the snack and toy bag. Use the service area for toilet and stretch breaks.

        Hanoi – Ninh Bình

The route runs along the Pháp Vân – Cầu Giẽ – Ninh Bình expressway. At Tràng An or Tam Cốc children get in and out many times; an adult checks every harness before the car moves.

        Đà Nẵng – Hội An

A short coastal run suited to families with toddlers. A 7-seater holds child seats, a stroller and beach gear.

Flying or rail arrivals: plan the seats in advance

        1. For an airport pick-up, give the number of adults and children and each child's height and weight; we choose a car with enough rear places.
        2. The driver tracks the flight, waits through delays with no airport waiting fee, and the child seats are already fitted.
        3. Arriving by sleeper train at Đà Nẵng, Huế or Nha Trang: send the train code and carriage; the driver waits at the exit with the seating ready.
        4. Luggage: about 3 suitcases in a 4–5 seater, 4 in a 7-seater, 6–8 in a 16-seater or 9-seat limousine; child seats and strollers take extra space, so mention them.

On a self-drive rental, who is responsible?

On a self-drive hire you are the driver and responsible for where children sit. At a roadside check, the driver shows the vehicle papers and licence; the rental contract does not shift that responsibility to the rental company.

Keeping children settled on long drives

Splitting an extended family for Tết

Grandparents, two couples and four grandchildren aged 2 to 9, with 6 suitcases and some gift boxes. Two compliant layouts:

        Option Vehicle Seating Luggage
One vehicle 16 seat Grandfather in front; children in two middle rows with an adult in each; grandmother and the other adult at the back About 6–8 suitcases plus gift boxes
Two vehicles Two 7-seaters Two children in row two of each, adults in front and row three About 4 suitcases each with row three partly folded

Neither needs a child in the front. Two cars are more flexible if the family splits to different towns after Tết.

A one-minute check before setting off

        1. Count children against safe rear places.
        2. Each child seat is firm, harness straps flat, chest clip at armpit level.
        3. Older children on boosters: shoulder belt over the collarbone, lap belt low on the thighs.
        4. Rear child locks are on.
        5. No child in the driver's row.
        6. Hard objects stowed in the boot or a zipped bag.
        7. The adult beside the children knows the route and next stop.

It takes under a minute and spares the family worry, and a roadside stop, all trip long.

        Seating a larger family

With two or more children, plan seats before choosing a car. A 5-seater's back row fits two child seats with an adult in the middle only if the seats are slim, so many families take a 7-seater: one seat per child in row two, adults in row three. The front seat is not for children covered by the law, so the second adult sits there. Give the children's ages and heights when booking and we will suggest a car and fit the seats.

        Choosing a vehicle

Bigger families: a 7-seater or 16-seater so no child ends up in the driver's row. For seat types by age, see child car seats for self-drive rentals.

Every quote is 10% off. With self-drive, fuel and tolls are on you, and petrol, diesel or a VinFast EV is your choice. Contracts are signed by both parties.

        FAQ

My child is 11 but under 1.35 m. Can they sit in front?

The rule covers children under 10 and under 1.35 m; others are not banned, but the back is still safer.

Can I switch off the airbag instead?

That does not change the rule; children in that group must still ride in the back.

Grandparents in front, children behind: is that right?

Yes, that is the correct arrangement; under-10s below 1.35 m must not sit in the driver's row.

Can a child sit on a lap in the back?

Use a child seat; a lap gives no protection under hard braking.

        Not enough rear seats?

Take a bigger car or two cars rather than a child in front.

Can a child ride in front of a double-cab pickup?

No; a double cab has a rear row, so the child sits there. The exception covers single-row vehicles only.

Do we need child seats in a 16-seater?

Advisable for small children; tell us in advance so we prepare seats that suit the van's rows.

Who shows documents at a roadside check?

The driver, including on a self-drive rental.
